AI transparency

Last updated: 25 August 2026

dutcha2.nl uses artificial intelligence (AI). This page explains where AI is used, how we mark AI content, and how we classify the service under the EU AI Regulation (Regulation (EU) 2024/1689, the "AI Act").

Our role under the AI Act: we offer the AI evaluation system under our own name and are, to that extent, a provider within the meaning of Art. 3(3) AI Act — the fact that it is free of charge changes nothing about that. The third-party AI models with which the pre-produced content is created we use as a deployer within the meaning of Art. 3(4).

Where AI is used

  • Content: exercise texts, tasks, illustrations and audio recordings (synthetic voices) are created with the help of AI. They are produced editorially in advance — without user data — and reviewed by us; they may still contain errors.
  • AI evaluation: your written and spoken practice answers are evaluated automatically by an AI system. The evaluation is a learning aid: it may contain errors, is not an official exam result, and is issued to no one but you.

How we mark AI content (Art. 50 AI Act)

  • A notice before every AI interaction: before you submit an answer you learn that an AI system will evaluate it, that the feedback is for practice only and may contain errors — together with the request not to enter real personal data in the text fields or recordings.
  • An annotation directly on every evaluation result: "Automated AI evaluation — not an official exam result; may contain errors."
  • A visible "AI content" label at the top of every page carrying AI-made content, opening an explanation of how our texts, images and voices are produced.
  • A synthetic-voice notice on the listening exercises.
  • Machine-readable marking: AI-generated images carry the standardised label "trainedAlgorithmicMedia" in their IPTC/XMP metadata and audio files the same label in their ID3 metadata; our server additionally sends a machine-readable response header with these media files. Every page carrying AI-made content also includes a machine-readable declaration with the same IPTC label, and the AI evaluation result is marked in the page with an attribute identifying it as AI-generated content.

Classification under the AI Act (Annex III, Art. 6)

The AI Act classifies certain AI systems in education as high-risk (Annex III point 3(b): systems for evaluating learning outcomes). We examined whether our AI evaluation feature falls under it.

The result of our documented assessment: the feature is not a high-risk system within the meaning of Art. 6(2) AI Act, because the derogation of Art. 6(3) applies. This is a voluntary, free self-study offering; the evaluation is purely formative, has no legal or comparable effect, leads to no certificate, decides on no access to education or an exam, and is transmitted to no examination body or other party. Only the individual, voluntarily submitted answer is evaluated; no profiling takes place — the system builds no profile of you and predicts no exam success. The exam that counts is conducted exclusively by the official exam organisers, outside this system.

We documented this assessment in writing under Art. 6(4) AI Act (as of 19 August 2026) and will provide it to the competent authorities on request. The derogation in Art. 6(3) carries its own registration in the EU database under Art. 49(2) AI Act; that obligation follows the general date of application of the AI Act and is not deferred by amending Regulation (EU) 2026/1744 — that deferral covers Chapter III, Sections 1 to 3 only (with the exception of Art. 6(5)), which apply to AI systems classified as high-risk pursuant to Art. 6(2) and Annex III only from 2 December 2027. We will complete that registration within the statutory deadlines.

Your role

Whether and how you study with our materials is entirely your decision. The AI evaluation replaces neither a teacher nor an official exam result — a diploma or certificate can only be obtained at the exam held by the official exam organisers. We are an independent private project and are not affiliated with any examination institution or public authority.
